FBI Closes Megaupload and arrests several of their employees

As far as I know, they did everything correctly to take this site down. It’s dumb to argue that nothing should be done about pirate sites, it just needs to be done in a way that doesn’t compromise a free internet, which is where SOPA failed miserably and DMCA has been hit or miss (but mostly hit).

They obviously have substantial evidence that the distribution of copyrighted materials was intentional or else they would have taken down all the similar upload sites as well. It’s a shame 'cause I legitimately used Megaupload all the time, but at first glance this looks like the system worked properly. All the more reason to not have bullshit SOPA/PIPA-like bills pushed through.

Of course, if it comes out that there were shenanigans that changes things, but I doubt that’ll happen. You’d have to be pretty fucking stupid to not see that the Mega-sites were pretty obviously made for distributing IP illegally.

They arrested people IN NEW ZEALAND for violating AMERICAN copyright laws for a website based in HONG KONG :hmph: !

Easier said than done. I have a friend who works (I use this term loosely as its more like does this and happens to get paid) at a porn site, in which his job is to constantly re-upload the files that get taken down from megaupload. File sites like this have a big issue regulating piracy because piracy sites love it because legally they can argue that they only provided links.

The didn’t go to New Zealand and arrest them. They got an agreement with the NZ government to have them arrested in New Zealand and extradited to the U.S. That’s standard procedure with Federal crimes, though not all other countries comply.

And just because you’re incorporated in Hong Kong doesn’t mean you aren’t in violation of U.S. law. There are plenty of ways to fall under U.S. jurisdiction if you aren’t careful, and the fact that they got a court order shows that the FBI was able to make a good case that Megaupload did something (or lots of things) that did.

This all looks pretty by-the-book and legit.

but even for people not using proxy or vm or nothing, its so easy to just say, someone else did it on my network, via wifi or whatever, and there´s no real proof x person did it

The U.S. doesn’t force other countries to extradite criminals to the U.S., and plenty of them don’t – or only do it for extreme crimes. Apparently, the U.S. extradition treaty with New Zealand allows it for certain copyright violations. Which isn’t uncommon at all.

Fuck, megaupload was good, short download timer, no ads, supported download accelerators, and had no captcha form, oh well still got medafire I guess, although people don’t use it as much as they should.
