I’m a bit confused as to what the limit means or what its purpose is if you can still be charged while under it. It’s like charging someone for speeding because they were just under the speed limit.
You can still be driving without due care and attention regardless of whether or not you’ve had a drink at all. I think that’s the difference here.
Okay, but thats not a DUI… its a citation for reckless driving or whatever. DUI means “driving under the influence” and if you’re not over the legal BAC limit, it means you are LEGALLY not under the influence of alcohol.
I suppose you can get a DUI for being stoned, which may be the case here. Whichis bullshit.
