Actually I’m more bothered with looking into how many assets he’s taken from the BM site and re-used without permission. Seems to be this guy’s standard modus operandi generally.

You should see how he acts towards the DS homebrew community.
He takes a free library of source code and distributes it in his “game maker”. The free version of his game maker is deliberately nerfed so that the registered version, which people pay him for, can have all the features, despite how EASY it is to make the games without his game maker as is.
It’s total bullshit.

I’m no lawyer, but people say it would be illegal to make a Half-Life themed game on the DS because it’s not on Source… Does this mean it would be illegal to make a flash movie about Half-Life, for example? I mean… unless he intends to SELL the thing, then it’s obviously illegal. But I’m not sure if making something inspired from HL would be illegal. And how about a disclaimer? I always wondered how it works… You see this everywhere: ‘this’ and ‘this’ are legal properties of ‘blahblahblah’ and blahblahblah no affiliation blahblahblah… Does it make the usage legal? You say it’s not exacly yours, but you’re still using it.
Anyway… not trying to defend the guy, not at all, just curious about these legal issues.

It isn’t illegal to use Half-Life themed ideas in a flash movie, or game, as long as it’s free.
Though, for something as serious as this guy is doing, would need Valves permission. Though, using direct assests from the game(ripping models, sounds, textures, etc.) could be considered illegal in a free game, especially if no credit is given to the origional creators.
Using the BMS logo and a Vort without permission is 100% illegal.
